The principal is the person who signs the POA to allow another person(known as the attorney-in-fact) to have certain powers to act on behalf of the principal.

The principal must express willingness, be mentally alert, and indicate an understanding of the document.

The Witness

The witness must be over the age of 18 and must be able to understand the significance of the document. The witness cannot be related to the principal by blood or marriage. The POA document will inform you of the number of witnesses needing to be present.

Notary Public

The power of attorney form must be signed by the principal in front of the notary public and the witness. The notary public will then sign and stamp the document. The notary public and witness must be two separate people, and neither of them can be named as an agent in your POA.
